Fast Flow Rental Agreement

 

“A Fast Flow Rentals is not just a quality service but a solution”

 

*AGREEMENT INTENT

Fast Flow, L.L.C. terms and conditions will apply to any and all tools and equipment rented by Fast Flow, L.L.C. Terms and Conditions apply to any and all rentals of Fast Flow, L.L.C.’s property.

 

Terms and Conditions:


“Customer of Fast Flow, L.L.C., will accept and agree to the rental Terms and Conditions of lease.”

 “Ownership of Property”

  • Fast Flow, L.L.C.’s rental equipment will at all times remain the property of Fast Flow, L.L.C.
  • Care, Custody, and Control of Fast Flow L.L.C’s rental equipment will remain the responsibility of the customer until the rental equipment lease is terminated, and Fast Flow L.L.C.’s equipment has been removed from the location of the jobsite.

Minimum Rental Period

  • A minimum of five (5) days rental will be charged on all equipment. Long term rental agreements are available and any Term or Condition for same shall be agreed upon by both Fast Flow, L.L.C. and the Customer prior to the commencement of the equipment rental.

Commencement of Rental Period

  • Rental period begins when equipment leaves Fast Flow, L.L.C.’s facility. Rental period ends upon return of the equipment to Fast Flow, L.L.C. facility located at 9700 Hwy 63, Moss Point, MS 39562.

Transporting of Equipment

  • The Customer will be responsible for all transportation and freight charges. The customer is fully responsible for any loss or damage which occurs during the transportation of the equipment.
  • Fast Flow can provide Hot Shot delivery & return transportation at reasonable rates.
  • Unless previous arrangements are made, no return equipment will be unloaded between the hours of 8:00PM and 7:00AM.
  • Fast Flow L.L.C will have 2 full business days to gather Fast Flow L.L.C.’s rental equipment from a jobsite once any rental lease is terminated.

Hold Harmless Policy

  • The Customer agrees to indemnify and hold Fast Flow, L.L.C. harmless from any and all damages or losses, by Customer or their Agent, which may result from rental, usage, or transportation of Fast Flow L.L.C.’s equipment.

                                                        Modification of Equipment                             

  • The Customer is strictly prohibited from by-passing any safety devices, or making any modifications to Fast Flow, L.L.C. equipment.

“Customer Responsibility

A.     The Customer is responsible for any loss or damage to Fast Flow, L.L.C.’s equipment which occurs during the rental of said equipment.

B.     All costs for repairs made to damaged equipment will be charged to the Customer.

C.    Rental equipment lost, not returned, or damaged beyond repair will be billed to the Customer at the current replacement prices.

D.    HURRICANE SEASON – when a hurricane watch (sustained winds of 73 mph or greater are possible within 36 hours) is issued by the National Weather (Hurricane) Center to include Moss Point, MS and / or the jobsite location of the rented equipment Fast Flow L.L.C. will cease to receive equipment from customer locations or docks, unless otherwise notified. All equipment not returned to our Moss Point facility at this point, will remain on “RENT” status and the customer will be responsible for the “CARE, CUSTODY and CONTROL” of such equipment.

E.     The Customer will be responsible for returning all equipment in proper working order, just as delivered, clean of any fluids, products, cement, Drilling Mud, Naturally Occurring Radioactive Material (NORM), and/or any other non-belonging substance.

F.     The Customer will be charged for disposal costs and time necessary to remove and clean residual material from equipment.

G.    All rentals lasting longer than 21 days, routine service and maintenance will be the responsibility of the customer. At the customer’s request Fast Flow Service Technicians will provide on site routine service and maintenance; this can be scheduled at the current Fast Flow Service Technician hourly labor rate plus materials.

H.    At any time during a maritime operation, the customer accepts all responsibility for the maritime workman’s compensation of each Fast Flow employee on site.

 Terms of Payment

  • All rental charges will be due and payable thirty (30) days following invoice date. The Customer agrees to pay 1 ¾ % monthly rate of interest on unpaid invoices. Customer will be responsible for all collection costs and attorney’s fees.
  • Invoices will be sent via U.S. Postal Service, E-mail, and Fax. Invoices will arrive monthly. Once the Fast Flow credit limit of $30,000.00 is reached a payment of the full outstanding balance will be required. 

“Option to Renew”

§  If the customer is not in default upon the expiration of the rental period, customer shall have the option to renew the rental period for a similar term on such terms as the parties may agree at the time of such rental.

“Option to Purchase”

§  If the customer is not in default under this agreement, the customer shall have the option to purchase items of equipment at the end of the rental term, for an agreed upon price between the customer and Fast Flow L.L.C. The customer shall exercise this option by providing written notice to Fast Flow of such intent at least 10 business days prior to the end of the rental term.
